Legal Pluralism And Local Wisdom In Addressing Overcrowding At Class Iia Correctional Facility Lhokseumawe

Overcrowding in Indonesian correctional facilities has become a critical issue, reflecting systemic problems in the criminal justice system that prioritize imprisonment as the main form of punishment. This study analyzes legal pluralism and Acehnese local wisdom as alternative solutions to address overcrowding at the Class IIA Correctional Facility in Lhokseumawe. Legal pluralism, which integrates state law, customary law, and Islamic law, provides diverse mechanisms for dispute resolution and alternative sanctions, reducing dependence on imprisonment. Acehnese local wisdom, rooted in deliberation (musyawarah), reconciliation, and restorative practices, enables many minor cases to be resolved outside formal courts, fostering social harmony and compliance. Employing an empirical juridical method through interviews, observation, and literature review, this research identifies that restorative justice, customary dispute resolution, and uqubat ta’zir under Qanun Jinayat are effective strategies to alleviate overcrowding.
