Analysis of the Consumer Dispute Settlement Agency (BPSK) Decisions in the Objection Process at the Lhokseumawe District Court (A Case Study of Decision No. 3/Pdt.Sus-BPSK/2022/PN Lsm)
Keywords:
BPSK, Objections, District Court, Consumer DisputeAbstract
This study aims to analyze the legal considerations of the Lhokseumawe District Court judge regarding objections to the decision of the Consumer Dispute Settlement Agency (BPSK) in Case Number 3/Pdt.Sus-BPSK/2022/PN Lsm, as well as to review the legal consequences of that decision on the validity and effectiveness of the BPSK institution. This research uses a normative juridical method with a statutory approach and case approach. The results show that the judge in this case placed greater emphasis on the absolute authority of the BPSK institution rather than consumer protection aspects, which resulted in weakening the effectiveness of the BPSK as a fast, simple, and low-cost consumer dispute resolution body.
