Narcotics cases in Indonesian legal practice remain debated due to the lack of detailed procedural rules. This study examines the legal procedure for third parties to challenge court rulings that confiscate property and analyzes judicial considerations in adjudicating such objections. Using a normative juridical method with statute and case approaches, supported by descriptive analysis, the study focuses on Lhokseumawe District Court Decision No. 2/Keberatan/2024/PN Lsm Jo. 157/Pid.Sus/2024/PN Lsm, where a third party objected to the confiscation of a vehicle used as evidence. The objection, filed in good faith, was treated as a criminal objection with the burden of proof on the applicant. Judges assessed ownership documents, testimonies, and evidence before ruling that the vehicle belonged to the third party and ordering its return. The decision highlights substantive justice beyond formal interpretation and recommends clear procedures to ensure legal certainty and consistency.
